 welcome....   This web site was designed with the intent 
			to inform interested parties, at how the West Australian Third Party 
			Compensation Scheme for Victims of Motor Vehicle Accidents works or 
			more importantly doesn’t work. In West Australia, third party 
			victims of Motor Vehicle Accidents, have to deal with the Insurance 
			Commission of West Australia/ICWA, a wholly government owned 
			organization. My case will not cause any change or inquiry 
			in how ICWA works or more importantly how it doesn't work! I had a 
			good income and what some people still regard as a dream job. As a 
			result, my case brings out a uniquely Australian trait "The Tall 
			Poppy Syndrome". Before everyone gets offened because I have just 
			linked predominantly Australian's to the Tall Poppy Sydrome, I 
			recommedyou
			
			read this and then tell me I am wrong. An Australian journalist once explained to 
			me; "News stories are products like any other product and is 
			only of interest and marketable to the population sections the 
			particular news outlet targets".  The Australian motto of 
			a Fair Go, tends to only apply to particular social economic groups. 
			At some point however, a case from the right group will eventually 
			attract the media and therefore the public interest and hopefully 
			trigger an inquiry into ICWA and the organizations that are meant to 
			protect the public from unfair and outrageous treatment by 
			government organization's. These organization's include West 
			Australian Ombudsman and the Corruption and Crime Commission.  This website I hope however, will show what 
			in many cases is missing, a clear paper trail  and thereby deny 
			the parties involved, politicians, senior bureaucrats and government 
			organization's and departments, from being able to argue they were 
			not informed, did not know and the favorite argument in such cases, 
			
			Plausible Deniability! For far too long government 
			organization's and public servants have been able to avoid taking 
			responsibility in cases such as the sexual abuse of children at the
			
			Kattanning Youth Hostel at the hands of Churches, the deaths 
			caused by the Labor's
			
			botched home insulation rollout and the
			
			Education Revolution. You will note that in the current
			
			Royal Commission into sexual abuse of children by the clergy, 
			the role and failure of government child welfare departments, 
			judiciary and police meant to protect these children, is not being 
			investigated! Hundreds of pages of reports, tens of millions of 
			costs and yet not one public servant was fired, demoted or has had 
			to face criinal charges and no real change has taken place. One 
			sentence in the Royal Commission Inquiry, into home insulation 
			rollout says it perfectly: "It would be essential, however, for 
			such a scheme to have any realistic prospect of achieving the 
			objectives that I consider essential, that it not be one run by the 
			Government itself. It has shown itself, in the manner I have shown, 
			to lack insight into its own shortcomings" (Commissioner Ian 
			Hanger AM QC).

          | This website is based on the 
		  experience of one family, who while seated in a restaurant in 
		  Northbridge/Perth WA, on the 10th of May 2003, were struck 
		  by a delivery van which reversed at high speed into the alfresco 
		  dinning area, at the former Vino Vino restaurant on James Street, a 
		  accident which turned their lives upside down. If you think this 
		  couldn’t happen to you, think again. ICWA likes to claim, that only 
		  1-3% of claims go to trial and likes to portray these claimants as 
		  unreasonable. What they don’t say, is that 90% of the cases that go to 
		  trial, are large claims which have caused damages of approximately a 
		  quarter of a million or more. You don’t need to be a millionaire to 
		  have a multi million dollar claim. Simply requiring 24/7 care for the 
		  rest of your life, after a motor vehicle accident, will result in a 
		  multi million dollar claim.   What followed my family's MVA, was a nine year 
		  ordeal to receive compensation and which continues to this day. It 
		  highlights a dysfunctional legal system, out of control public 
		  servants and the failure of government organizations, such as the 
		  Corruption and Crime Commission/CCC and the WA Ombudsman, to protect 
		  the general public from ICWA. It also tries to highlight, on how 
		  government organization such as ICWA, CCC and the WA Ombudsman and 
		  their public servants, hide behind privacy legislation and the 
		  inability to dismiss a public servant for improper behavior or serious 
		  Conflict of Interest. Additionally I wish to highlight:  
			  
			  How ICWA can withhold ALL evidence from 
			  the court which supports the injured persons claim. 
			  The fact that during the entire 
			  compensation process, the often complex medical evidence, is 
			  assessed by public servants, that have no medical training 
			  whatsoever and yet it is these very people, who will decide 
			  whether the medical evidence is valid or not whether treatment is 
			  approved and whether treatment that is recommended by your 
			  treating doctors is paid for by ICWA.
			  The ICWA Case Manager's, have every 
			  interest in denying as many treatments as possible, as agreeing to 
			  pay for a treatment, can be seen as acknowledging liability for 
			  the injury! 
			  To this very day, I have been unable to 
			  find a single medical specialist, who was willing to invoice ICWA 
			  directly for his treatment. The reason given by these specialists 
			  is always the same, ICWA does not pay in the majority of cases, 
			  irrespective to any claim number ICWA may have given to the 
			  patient. The amount of material is overwhelming and 
		  therefore divided into subjects, ICWA, WA Ombudsman, Legal System, 
		  Medical Evidence etc. The more you read, the clearer it becomes how 
		  government organizations are more interested in protecting themselves, 
		  maintaining their privileges, than protecting the very public, they 
		  are meant to serve. The author is not only interested in 
		  highlighting his case, but is also interested to hear from other West 
		  Australian Motor Accident Victims with similar cases and outcomes.  If you think the pain and suffering is the 
		  worst part of being an innocent third party victim of an MVA. 
		  The reality is, that surviving the accident is the easy part, the 
		  question is, will you survive what follows?

			Tall poppy syndrome:If you think this can only happen to well off individuals. Think 
			again, anybody whether you are a single mum, child, pensioner or 
			unemployed person can wind up in the same situation. The innocent 
			victim of a motor vehicle accident only needs to require 24/7 
			medical care for the rest of his life for his compensation claim to
